Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of the website, digital products, online courses, membership community, and any other services (together, "Services") provided by Confident Costing ("we", "us", "our"), a trading name operated as a sole trader in England and Wales.

By purchasing any product, subscribing to any service, or downloading any free resource from Confident Costing, you agree to these Terms in full. If you do not agree, you must not use our Services.

These Terms are governed by the laws of England and Wales. Any dispute arising under them will be subject to the exclusive jurisdiction of the courts of England and Wales.

2. Important Disclaimer — Not Financial or Investment Advice

This is the most important clause in these Terms. Please read it carefully.

All content, products, courses, community discussions, reports, and communications produced by Confident Costing are provided for general educational and informational purposes only.

Nothing we produce constitutes, and should not be relied upon as:

- financial advice

- investment advice

- accounting advice

- legal advice

- professional business advice of any kind

Confident Costing is not authorised or regulated by the Financial Conduct Authority (FCA). We do not hold any licence, authorisation, or registration to provide regulated financial or investment advice under the Financial Services and Markets Act 2000 or any related legislation.

The analysis, case studies, frameworks, scorecards, and commentary we produce are based on publicly available information and historical case studies. They reflect educational pattern recognition, not professional analysis of your specific circumstances.

Before making any financial, investment, or business decision, you must seek independent advice from a suitably qualified and FCA-regulated professional. We accept no responsibility for any decision made, or loss suffered, in reliance on our content, products, or community discussions.


3. Who We Are and Who May Use Our Services

Confident Costing is operated by an individual sole trader based in England. We are not a limited company.

Our Services are intended for adults aged 18 or over. By purchasing or accessing our Services, you confirm you are at least 18 years of age.

Our Services are available to customers in the United Kingdom and internationally. Where you are purchasing from outside the UK, you are responsible for ensuring your use of our Services complies with your local laws.


4. Products and Services

We offer the following types of Services:

Free resources — including lead magnets, scorecards, and email newsletters, provided at no charge in exchange for your email address and consent to receive communications from us.

Digital products — including PDF workbooks and digital templates (such as Notion templates), available for one-off purchase.

Online courses — pre-recorded video-based learning modules, delivered via a third-party platform (such as Teachable or Podia), available for one-off purchase.

Membership community — a subscription-based community hosted on a third-party platform (Skool or similar), billed on a recurring monthly basis.

Email content — newsletters and automated email sequences provided as part of our free and paid Services.

Product descriptions, prices, and availability are set out on our website at the time of purchase and may change without notice. All prices are displayed in British Pounds Sterling (£) and are inclusive of any applicable VAT where stated.


5. Orders and Payment

When you place an order for a paid product or subscribe to a paid service, you are making an offer to purchase. A contract between us is formed when we confirm your order (by automated email or delivery of access) or, in the case of a subscription, when your first payment is processed.

Payment is processed via third-party payment processors including Stripe and/or PayPal. By purchasing, you agree to the relevant payment processor's terms of service. We do not store your payment card details.

We reserve the right to decline any order at our sole discretion. If we decline an order after payment has been taken, we will issue a full refund promptly.


6. Digital Products — Delivery and Access

Digital products (PDF workbooks, templates) will be delivered to the email address you provide at the time of purchase, or made available for download via a link, immediately or within 24 hours of confirmed payment.

You are responsible for providing a correct and functioning email address. We are not liable for non-delivery caused by an incorrect email address or spam filtering.

Access to course content is provided via our chosen course hosting platform. You are responsible for creating and maintaining your account on that platform. We are not responsible for third-party platform outages, changes, or discontinuation.


7. Cancellation Rights — Digital Content (14-Day Rule and Waiver)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel a purchase of digital content within 14 days of the date of purchase, without giving any reason ("cooling-off period").

However, if you request immediate access to digital content (e.g. by clicking a download link, accessing course content, or confirming access before the 14-day period has elapsed), you expressly acknowledge and agree that:

- you are requesting that we begin supplying the digital content immediately

- you understand that your 14-day right to cancel will be lost once you access or download the content

This waiver will be explicitly requested at the point of purchase with a tick-box or equivalent confirmation. If you do not confirm the waiver, access will not be provided until the 14-day cooling-off period has expired.

To exercise your cancellation right before accessing content, contact us at support@confidentcosting.com within 14 days of purchase. We will confirm your cancellation and process a full refund within 14 days of that confirmation.


8. Subscriptions — Membership Community

8.1 Billing

The membership community is offered on a monthly rolling subscription at the price stated at the time you subscribe. Billing recurs on the same calendar date each month (or the nearest available date) until you cancel.

8.2 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access until that date. No partial refunds are issued for unused days within a billing period already paid.

To cancel: use the cancellation function within your community account on the hosting platform (Skool or equivalent). If you experience difficulty cancelling, contact us at support@confidentcosting.com and we will process the cancellation manually within 5 working days.

8.3 Price Changes

We may change the subscription price at any time. We will give you at least 30 days' written notice (by email to your registered address) of any price increase. If you do not wish to continue at the new price, you may cancel before the new price takes effect without penalty. Continued use of the subscription after the new price takes effect constitutes acceptance.

8.4 Free Trials

Where a free trial is offered, it will convert to a paid subscription automatically at the end of the trial period unless you cancel before the trial ends. We will remind you by email before the trial ends.


9. Refund Policy

9.1 Digital products and courses

Subject to your statutory cancellation rights under clause 7, all sales of digital products and online courses are final and non-refundable once access has been provided. This is because the content cannot be returned or made inaccessible once delivered.

We will issue a full refund, at our discretion, in the following circumstances:

- You have not accessed or downloaded the content and request a refund within 14 days of purchase

- The product was materially misdescribed on our website

- There is a technical failure on our part that prevents delivery

9.2 Subscriptions

No refunds are issued for subscription payments already processed. Cancellation (clause 8.2) stops future billing.

9.3 Your statutory rights

Nothing in this refund policy affects your statutory rights under the Consumer Rights Act 2015, including your right to a repair, replacement, or refund where digital content is not of satisfactory quality, not fit for purpose, or not as described.


10. Intellectual Property

All content produced and published by Confident Costing — including but not limited to videos, scripts, workbooks, course modules, templates, scorecards, reports, frameworks, email content, and branding — is the intellectual property of the operator of Confident Costing and is protected by copyright and other applicable intellectual property laws.

Personal licence: When you purchase a digital product or course, or subscribe to the community, you are granted a non-exclusive, non-transferable, personal licence to use the content for your own private educational purposes only.

You may not:

- copy, reproduce, redistribute, or resell any of our content (in whole or in part)

- share login credentials or access links with third parties

- use our content to create derivative works for commercial purposes

- present our frameworks, templates, or materials as your own

Any unauthorised use may result in termination of your access without refund and may give rise to a claim for damages.

Community members may share and discuss content within the community platform for the purposes of mutual learning. Community posts and contributions remain the intellectual property of their authors; by posting in the community you grant Confident Costing a non-exclusive licence to republish or reference your contribution for promotional purposes (e.g. testimonials), unless you request otherwise.


11. Community Conduct

Members of the Collapse-Proof Community (or any successor community) agree to the following conduct standards:

- Treat other members with respect. No harassment, abuse, discrimination, or threatening behaviour.

- Do not post spam, unsolicited promotional content, or affiliate links without prior permission.

- Do not share confidential information belonging to third parties (including your employer).

- Do not post content that constitutes financial, legal, investment, or professional advice directed at other members as if it were regulated advice.

- Do not share access to the community with non-members.

We reserve the right to remove any post, warn, suspend, or permanently remove any member who breaches these standards, at our sole discretion. Removal for conduct breach does not entitle the member to a refund.


12. Limitation of Liability

To the maximum extent permitted by applicable law:

- We provide all content, products, and Services on an "as is" basis. We make no warranty that any product will achieve a particular outcome for you.

- We are not liable for any indirect, consequential, incidental, or special loss arising from your use of our Services, including but not limited to: loss of profit, loss of business, financial loss, or loss of data.

- Our total aggregate liability to you for any claim arising out of or in connection with these Terms shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited by English law.

Nothing in these Terms affects your statutory rights as a consumer under English law.


13. Third-Party Services and Links

Our Services depend on, and may link to, third-party platforms and services including but not limited to: Systeme.io, Skool, Teachable, Podia, Stripe, PayPal, YouTube, Instagram, Canva, and Notion. These are independent services with their own terms and privacy policies.

We are not responsible for the content, availability, security, or practices of any third-party service. Links to third-party sites are provided for convenience only and do not constitute endorsement.


14. Data Protection and Privacy

We process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Our Privacy Policy, which forms part of these Terms, sets out in full how we collect, use, store, and protect your personal data, and how you can exercise your rights.

Key points:

- Email list and payment processing are handled via Systeme.io (operated by ITACWT Limited, Ireland), hosted on AWS Ireland. Your data remains within the EU/EEA. No international transfer to third countries is involved.

- We collect only the data necessary to provide our Services and communicate with you.

- You have the right to access, correct, delete, or port your data, and to withdraw consent at any time.

- To exercise any data protection right, contact us at support@confidentcosting.com.

You can unsubscribe from our email list at any time using the unsubscribe link in any email we send you.


15. Changes to These Terms

We may update these Terms at any time. We will notify subscribers of material changes by email to the address held on our records, giving at least 14 days' notice before changes take effect. Continued use of our Services after the effective date of revised Terms constitutes acceptance.

The current version of these Terms is always available on our website. The version date is shown at the top of this document.


16. Termination

We may terminate or suspend your access to any Service immediately and without notice if:

- you breach any material term of these Terms

- we reasonably suspect fraudulent, abusive, or unlawful use

- we cease to offer that Service

On termination, your licence to use our content ends. We may, at our discretion, issue a pro-rata refund for any unexpired subscription period in cases of termination by us without cause. Termination for breach does not entitle you to a refund.


17. Complaints

If you are unhappy with any aspect of our Services, please contact us in the first instance at support@confidentcosting.com. We aim to respond to complaints within 5 working days and to resolve them within 28 days.

If we are unable to resolve your complaint, you may refer it to an alternative dispute resolution (ADR) scheme. As a UK consumer, you may also have recourse to the courts of England and Wales.


18. Entire Agreement

These Terms, together with our Privacy Policy and any order confirmation or product description provided at the time of purchase, constitute the entire agreement between you and Confident Costing in relation to the Services. They supersede all prior representations, agreements, or understandings.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force.

A failure by us to enforce any right under these Terms at any time does not constitute a waiver of that right.


19. Governing Law

These Terms are governed by the laws of England and Wales. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that consumers based in Scotland or Northern Ireland retain the right to bring proceedings in their local courts.
